Work-based Learning Partnership Agreement

Businesses and industry professionals, herein referred to as "Business Champions" sponsoring work-based learning experiences for use by the Pikes Peak Business and Education Alliance, herein referred to as "PPBEA" and its participating member school districts agree to the following terms and conditions.

Purpose of Agreement:

The purpose of this Agreement is to establish an affiliation between the Business Champion and PPBEA participating member school districts in a workforce talent development process. This process will provide an opportunity to the Business Champion to inform and participate in curriculum development, if desired, and work-based learning and training experiences that will benefit businesses and students in connecting required industry skill sets with student qualifications for eventual entry into employment. The types of work-based learning and training experiences available to the Business Champion include job shadows, industry immersions, classroom presentations, mentorships, unpaid or paid internships, or customized pre-apprenticeships.

Term of Agreement:

This agreement has no term. Either party may dissolve this relationship at any time.

General Partnership Conduct:

Partners should conduct themselves in a professional manner in all dealings related to work-based learning experiences. As a principle of fundamental business fairness, partners bear responsibility for their own actions, including negligence, should that occur. Partners shall provide access to work-based learning experiences for students in safe environments, where the students will have adequate supervision and the necessary tools and equipment to perform the scope of learning detailed in each work-based learning opportunity. The student's work will be rewarded with agreed upon compensation, if any, and agreed upon academic rewards indicated by academic requirements of the Colorado Department of Education. The student must be aware of the fact that each chosen career field has established a set of general standards that speak to the professional conduct of people engaged in work within that occupation. It is the student's responsibility to fully understand, and abide by, those professional standards of conduct, as well as those established by the Business Champion, and any standards established by the PPBEA participating member school districts. Partners shall carry appropriate insurance, including policies mandated by federal, state, and local law. These include, but are not necessarily limited to general liability, professional liability, and worker's compensation insurance.

Business Champion Acknowledgements:

  • Appoint and identify a single point of contact to communicate with PPBEA participating member school district point of contact.
  • Student participation in a work-based learning experience, for which the Business Champion is not the employer of record, will not displace existing staff.
  • Observe state and federal labor laws, especially those related to minors in the workplace.
  • Provide a safe working environment and the equipment necessary for the student to effectively conduct the scope of learning identified in the Business Champion's sponsored work-based learning opportunity.
  • Train and supervise the student; assign duties that are career-related; and, provide constructive feedback to ensure a worthwhile training experience.
  • Allow time for, and arrange to be present at, periodic student performance evaluations arranged through PPBEA or school district staff.
  • Notify PPBEA participating member school district point of contact in the event of any problems regarding a student's conduct or performance. Notify the PPBEA participating member school district point of contact prior to taking any action in the event the student's position must be terminated. Per Colorado law, all work-based learning experiences will be considered at-will.
  • Inform students of applicable company policies and regulations. Each student is expected to perform with high standards at all times and comply with all Business Champion written policies and regulations.
  • Be responsible for the acts and omissions of its employees and agents and shall maintain adequate insurance, which may include a bona fide self-insurance program, to cover liability arising from the acts and omissions of Business Champion's employees and agents. Business Champion is not responsible for maintaining insurance coverage for liability arising from the acts and omissions of PPBEA participating member school district employees and agents.
  • Does not discriminate on the basis of race, color, national origin, sex, disability, or age in work-based learning experiences.

PPBEA Participating Member School District Acknowledgements:

  • Appoint and identify a single point of contact to communicate with Business Champion point of contact.
  • Provide insurance coverage for students entered into unpaid workplace training experiences with Business Champion. Students in practicum will be covered under the PPBEA participating member school district's General Property & Liability and Worker's Compensation Insurance programs while working within the scope of learning sponsored by the Business Champion and approved by PPBEA. A statement of insurance coverage will be provided to Business Champion prior to student placement and entry into the workplace.
  • Provide an administrative framework and a teaching faculty adequate in number, qualifications and competence to develop and carry forward industry-related curriculum and instruction.
  • Be responsible for developing and carrying out procedures for student selection and admission into work-based learning experiences to meet Business Champion qualifications and requirements.
  • Be responsible for the acts and omissions of its employees and agents and shall maintain insurance coverage to cover liabilities arising from the acts and omissions of employees, students, and agents participating under this Agreement. PPBEA participating member school districts are not responsible for maintaining insurance coverage for liability arising from the acts and omissions of Business Champion's employees and agents.

Joint Partner Acknowledgements:

  • Comply with the Colorado Student Transparency and Security Act, the Family Education Rights and Privacy Act (FERPA), and all applicable state and federal law.
  • Create meaningful work-based learning experiences including providing work site location(s), training duties, competency-based outcomes, work hours and rate of compensation, if applicable.
  • Require withdrawal or dismissal from participation of any student whose performance record or conduct does not justify continuance.
  • Neither partner is obligated to provide for the student's transportation to and from the workplace or for health insurance for the student.
  • Convene, at least annually, to improve processes, procedures and training outcomes for Business Champion and students.
  • Comply with all applicable state and federal laws, rules, regulations, and executive orders governing equal employment opportunity, immigration, nondiscrimination, including the Americans with Disabilities Act, and affirmative action. Will not discriminate on the basis of race, color, national origin, sex, disability, or age in work-based learning experiences.
